We are pleased that you have chosen to review our Terms of Use, which are incorporated by reference into the website (Site) and govern its use and operations. These Terms of Use are an agreement between you and ATB Financial (ATB) and you agree that these apply and govern your use of this Site. For assistance with use of the functionality forming part of the Site, you should consult the “How It Works” section of the Site.

Benevity Site:

When you click on Donate, Donate Now or Redeem a Gift Card, you:

- will be redirected to the ATB Cares site and webpages (Benevity Site) operated by Benevity, Inc. (Benevity) and for which the Benevity Terms of Use (Benevity Terms) apply; please read through the Benevity Terms carefully as they give additional details and terms and conditions for how the Benevity Site operates and how your donation may be processed.

- acknowledge that donations are processed through the Benevity Site by Benevity, not by ATB. ATB does not collect nor receive any personal information, nor does it process or direct any of the donation funds on your behalf;

- agree that you are bound by the Benevity Terms in addition to these Terms of Use;

- acknowledge that ATB is not responsible for the operation of the Benevity Site and you agree that section 2 “Releases and Limitation of Liability” in the Benevity Terms apply and are to be read as also applying between ATB and you as if ATB were a party named in that section entitled to release. You are subject to the limitation of liability in that section as if it applied in relation to you and ATB.

Other terms that apply in relation to the Benevity Site:

For the purposes of the Benevity Terms, ATB is a Corporate Sponsor and may, in relation to matching offers made by ATB, be a Matching Partner.

Unless otherwise identified in a matching offer or as part of a particular donation offer, ATB does not currently cover the cost of the Cause Support Fee as defined in section 7.3 of the Benevity Terms.

Gift cards are not available for purchase on the Benevity Site. However, ATB may provide gift cards that allow you to redeem a donation amount through the Benevity Site. In that case, you are not entitled to any tax receipt.

Program Functionality:

ATB may, from time to time and in its sole discretion, establish a matching offer program for specific promotions. Such matching offer programs, if any, will be subject to additional terms and conditions, as determined by ATB in its sole discretion, including, but not limited to: (a) matched amounts would be subject to maximum amounts set by ATB; (b) the establishment of a matching program and its ongoing availability in respect of any particular special promotion would be subject to availability of funds as determined by ATB; and (c) ATB may terminate any such matching offer programs at any time with or without notice. You are not entitled to receive a tax receipt for any matched portion of a donation.

The organizations available to donate to on the Benevity Site are those contained in the Canada Revenue Agency’s list of registered charities. Neither ATB nor Benevity conduct any further due diligence on any charity that is available on the Benevity Site to receive donations, including what they use donated funds for or what their purpose is.
